PAYMENT

Before the start of every design project, the Client agrees to pay 50% deposit of the whole fee to KRAFIGS. The Client will pay the remaining balance of the whole fee before they receive the final files from KRAFIGS. The final files will only be sent to the Client when the final payment is received. KRAFIGS retains the right to discontinue or suspend any activity for any unpaid services.

LIABILITIES

KRAFIGS is not liable to the Client or any third party for any damages resulting from any part of this agreement such as, but not limited to, loss of revenue or anticipated profit or lost business, costs of delay or failure of delivery. The Client agrees to not hold the company liable for all claims, costs, and expenses, including attorney’s fees, due to materials included in the work at the request of the Client for which no copyright permission or release was requested. For example, if the Client supplies a photograph that they did not have the rights to, and they sue them, the Client cannot take action against the Designer/company for publishing this photograph on the client’s website or any website.

CLIENT’S RESPONSIBILITIES

The Client is fully responsible for proofing the book cover design provided by KRAFIGS before publishing or ordering any copies of the books. KRAFIGS will not be held financially or legally responsible for any problems, costs, fees, or expenses incurred by the client as a result of using the book cover design.

If the Client decided to make any changes after the final design has been approved and final files has been sent to the Client, an additional fee will be charged.

OWNERSHIP

Upon receipt of full payment, KRAFIGS grants the Client exclusive license to use the final cover design artwork for his/her/their book and promotional materials for his/her/their book excluding the rights to modify and resell it, which rights is retained by the company. KRAFIGS agrees that the design is produced with the intent to be unique and will not seek to resell. KRAFIGS, however, reserve the right to showcase or publish the final designs for company’s promotion and marketing, even after ownership has been transferred to the client.

LICENSE

KRAFIGS will only use royalty free stock images. Please note that the stock images that we provide is of standard license that allow print run up to 500,000. Extended license is needed if it exceeded print run of 500,000.

If the Client wish to use his/her/their own images, any proof of copyright permission, model/property release, or royalty free must be presented.

If the Client decided to use the cover design for his/her/their book merchandise (for example, t-shirt, mug, notebook, postcard, or poster), an extended license is required. The Client is responsible for purchasing the extended license for every image that plays a major role in the overall book cover design.

CONFIDENTIALITY

KRAFIGS agrees to protect all information and materials of the Client and keep this information obtained confidential, unless otherwise requested by the Client. However, KRAFIGS will be permitted to display the final work on their website or in promotional materials used for the company.

CANCELLATION

The Client may cancel the agreement, and the deposit will be refund to the client only before KRAFIGS start working on the cover design drafts. Once KRAFIGS has provided the design drafts to the Client, the deposit is non-refundable. In the event of cancellation of the project, the ownership of all copyright rights and original artwork shall be retained by KRAFIGS.
